Terms and Conditions

Any participation in Asymptote Club services is bound to these terms.

“Asymptote Club” is defined as the set of services hosted under the Internet domains “asymptote.club” and “asymptote.network”, as well as the individual Zebulon McCorkle who runs Asymptote Club.

Violation of these terms may result in account suspension, termination, or other action at Asymptote Club’s discretion.

Requirements

A user of Asymptote Club services must be at least 16 years of age or older.

This is for compliance with GDPR. In the future, we may integrate parental consent verification to enable users less than 16 years old.

Unauthorized access to or (even authorized) use of another’s account is not allowed.

Legal compliance

Use of Asymptote Club services must not:

  1. Be unlawful in any of the following juristictions or promote unlawful activities in said jurisdictions:

    • New Jersey, U.S.A.
    • Texas, U.S.A.
    • Your jurisdiction of residence
  2. Infringe on the rights any party, including third parties. These rights include, but are not limited to, intellectual property (such as patents, trademarks, and copyright) and privacy.

Acceptable use

Use of Asymptote Club services must not unfairly restrict other users’ use of any Asymptote Club services. This includes using excessive CPU and disk resources.

User-generated content

Much content on Asymptote Club services is generated by users. This content is bound by these terms.

Licensing on user-generated content

User-generated content can be classified in four ways:

  • Public

Meant for any person to access, download, and otherwise use in ways permitted by the service

Examples include public Git repositories and messages on public chat rooms.

  • Internal

Meant for any Asymptote Club member to access, download, and otherwise use in ways permitted by the service

Examples include messages on the Asymptote Lounge chat room.

  • Restricted

Meant for a restricted set of users to access, download, and otherwise use in ways permitted by the service

Examples include private Git repositories which are shared with other users and private chat rooms.

  • Private

Meant for only a single user to access, download, and otherwise use in ways permitted by the service

Examples include unshared private Git repositories, home directories, and email inboxes.

By submitting content to Asymptote Club services you grant Asymptote Club permission to:

  1. Distribute the content to the intended audience
  2. Allow users who are a part of the intended audience to create copies of the content using facilities built in to the service (such as forking on the Git service and quoting on a chat room)
  3. Store the content to allow (1) and (2)

Where the intended audience is one of the above four classifications.

Donations

Any donations made to Asymptote Club are just that: donations. No goods should be expected in return for a donation, and donations are non-refundable.

Warranty

No warranty of merchantability or warranty of fitness for a particular purpose is granted to Asymptote Club users by Asymptote Club.

Liability

Asymptote Club is not liable to any party for any damages that result from any matter related to Asymptote Club services.

Changes

Asymptote Club reserves the right to amend these terms at any time. We will notify users on a best effort basis using their Asymptote Club email addresses.

Privacy Policy

Asymptote Club doesn’t intend to collect or process any of your personal information without you being aware. Pretty much, if we have it, you explicitly gave it.

Data collected

Asymptote Club may store any data submitted to an Asymptote Club service, including but not limited to name, emails, Git repositories, build logs, and chat logs. If you are concerned about an unauthorized user gaining access to that information, you may

  1. Not submit it to an Asymptote Club service
  2. Encrypt the data with a strong encryption algorithm

    The Matrix chat system has built-in encryption.

Either of these will ensure that an unauthorized user cannot access sensitive information.

This data is collected for the purpose of offering Asymptote Club services.

Account termination

You may terminate your Asymptote Club account and have your information scrubbed at any time by contacting an Asymptote Club admin.

International data transfer

Asymptote Club infrastructure is based in the New Jersey, U.S.A. area. In most cases, and with the most sensitive information, encryption schemes such as HTTPS, STARTTLS, and SSH are in place to protect information during its transfer to Asymptote Club infrastructure.

Data controller

Asymptote Club operates as a data controller, and any data is controlled in compliance with the EU’s GDPR.

Data processors

Asymptote Club infrastructure is hosted on virtual private servers on the infrastructure of Vultr Holdings Corporation. A data protection addendum is available from administrators on request.

The GDPR grants you the following 8 rights:

Supervisory authority

If you have a complaint with regard to GDPR compliance, contact your country’s GDPR supervisory authority. As Asymptote Club is based in the United States, it does not have a local supervisory authority.

Asymptote Club reserves the right to amend this policy at any time. We will notify all users with their Asymptote Club email upon any changes.

DMCA/Copyright

If you don’t have a license for it, don’t post it on Asymptote Club infrastructure. That’s the gist.

Repeat offenders may be banned from using Asymptote Club services at discretion of Asymptote Club and its administrators.

Takedown notices

If you’re a copyright holder and your property is hosted on Asymptote Club without license, send a message (email or letter) to the designated agent containing the following:

  1. Link to any offending content

    Must contain links to every offending page. Only linked pages will be looked at and possibly taken down.

  2. Your contact information, including an email address

  3. The following statements:

    I have a good faith belief that use of the copyrighted materials described above on the infringing web pages is not authorized by the copyright owner, or its agent, or the law. I have taken fair use into consideration. 2. I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

  4. A physical or electronic signature

For best results, follow the GitHub guide to submitting a DMCA takedown notice.

The DMCA agent will work expeditiously to take down the offending content, publish your takedown request on the Asymptote Club website, and contact the offending member. The offending member may submit a counter-notice, which will be sent to you. If you have not taken legal action within 14 days of us delivering the counter-notice by email, Asymptote Club may reinstate the content.

A counter notice must contain the following:

  1. Any contested links from the takedown notice
  2. Your contact information, including an email address
  3. The following statements:
